REGULAR COUNCIL MEETING
AUGUST 10, 2004 – 6:00 P.M.
COUNCIL MEETING ROOM

MINUTES

The Mayor and Council of the City of Pineville met in regular session on the 10th day of August 2004 at 6:00 p.m. at Pineville City Hall.

1. The Mayor called the meeting to order.

2. Councilman Martin offered the invocation.

3. Councilman Bouchie led the Pledge of Allegiance.

4. Roll call was as follows:

Present Councilpersons Bishop, Dorn, Van mol, Bouchie, Martin
Absent None

5. On motion by Councilman Bouchie, seconded by Councilwoman Van Mol and passed, it was resolved to accept the minutes of the July 13th meeting as published.

6. On motion by Councilman Bishop, seconded by Councilman Dorn and passed, it was resolved to accept the financial report as read by the Mayor.

7. On motion by Councilman Martin, seconded by Councilman Bishop and passed, it was resolved to approve a request from Danny Jenkins to formally picket CLECO offices located on Donahue Ferry Road, Highway 28 E and Main Streets from 8:00 a.m. until 5:00 p.m. Monday – Friday during September and October 2004. This is relative to past work related issues.

8. On motion by Councilman Bishop, seconded by Councilman Dorn and passed, it was resolved to adopt an ordinance amending section 2-1.5 of the Code of Ordinances for the City of Pineville, To Modify the Salary of the City Clerk. Roll call was as follows:

9. Zoning Commission Chairman, Tom David, spoke regarding the public hearing held at 5:00 p.m. relative to the proposed Mobile Home Overlay District. Over the next several weeks, all comments or suggestions can be made by concerned citizens or Council members, which will be taken into consideration when drafting the final document for adoption. On motion by Councilwoman Van Mol, seconded by Councilman Dorn and passed, it was resolved to table the decision to adopt the currently proposed amendment regarding the Mobile Home Overlay district until a recommendation could be made by the Zoning Commission after next month’s meeting.

10. On motion by Councilman Dorn, seconded by Councilwoman Van Mol and passed, it was resolved to approve a resolution:
BE IT RESOLVED, that the Mayor is hereby authorized to declare as surplus, the non-working stove formerly located at the Main Street Community Center, so that it may be disposed of as necessary.

11. On motion by Councilman Martin, seconded by Councilman Bouchie and passed, it was resolved to approve a resolution:

WHEREAS, it is the policy of the City of Pineville that a safe workplace, free of unnecessary hazards, be made possible through careful planning, preparation, and good communication; and
WHEREAS, it is necessary to adopt policies and procedures concerning the safe changing / handling of chlorine and sulphur dioxide cylinders;
NOW, THEREFORE, BE IT RESOLVED that the policies and procedures set forth in the attached Exhibit “A”, relating to chlorine cylinders, and Exhibit “B”, relating to sulphur dioxide cylinders, be and hereby are adopted by the City of Pineville;
BE IT FURTHER RESOLVED that each employee is responsible for reading the above policies and procedures on the safe changing / handling of chlorine and sulphur dioxide cylinders, before beginning the task of changing / handling such cylinders. This assures that the employee knows the proper steps to follow; and
BE IT FURTHER RESOLVED that a copy of the attached Exhibits be displayed at or near the appropriate chlorinator or sulphonator, as applicable.

· On motion by Councilman Bishop, seconded by Councilwoman Van Mol and passed, it was resolved to add an item to the agenda at the request of Councilman Martin.

12. On motion by Councilman Martin, seconded by Councilman Bouchie and passed, it was resolved to introduce and accept for publication an ordinance to amend Ordinance No. 1329-2004 An Ordinance to Enact a Commercial Landscaping Ordinance for the City of Pineville to Establish Minimum Standards to Encourage and Promote the Maintenance and Establishments of the Unique Wooded Character of Pineville; to Encourage the Sustainable Use and Stewardship of the Land; and to Conserve and Enhance Properties and Their Value

· On behalf of Pineville Concerned Citizens (PCC), Angelina Iles mentioned the Bicycle Rodeo to be held this weekend, which will benefit Slocum Elementary School children. Anyone who wishes to register to vote may do so at this time as well.

There being no further business to come before the Council, on motion by Councilman Bishop, seconded by Councilwoman Van Mol and unanimously passed, it was resolved to adjourn the meeting. The benediction was offered by Mr. Lawrence Foster.
