SPECIAL COUNCIL MEETING
APRIL 8, 2005 - 5:30 P.M.

MINUTES

The Mayor and City Council of the City of Pineville, Louisiana, met in special session at Pineville City Hall on Tuesday, April 18, 2005 at 5:30 p.m.

1. The Mayor called the meeting to order.

2. Councilman Martin led the invocation.

3. Councilman Bouchie led the pledge of allegiance.

4. Roll call was as follows:

Present Councilpersons Bishop, Dorn, Van Mol, Bouchie, Martin
Absent None

5. On motion by Councilman Dorn, seconded by Councilwoman Van Mol and passed, it was resolved to accept the minutes of the March 8th meeting as published.

6. On motion by Councilman Bouchie, seconded by Councilman Martin and passed, it was resolved to accept the finance report as read by Kim Portier, Finance Director.

7. CONDEMNATION HEARING:

a. Mr. Wayne Dauzat, Code Enforcement Officer, addressed the Mayor and Council regarding the condition of the structure located at 205 Hattie Street, belonging to Joe Buckner. (Pineville file #05-300) Mr. Dauzat stated that notification of today’s hearing was sent to the responsible parties and receipt of such had been verified. Mr. Dauzat stated that the structure was beyond repair, literally falling in and it was his recommendation that the owner be given sixty (60) days to voluntarily remove it. If the structure is not removed at the end of the sixty (60) days, the City will proceed with securing bids and demolition with all costs incurred by the City for this demolition placed as a lien against the property. Although there was no one present to speak on behalf of the owner, there were also no comments for or against Mr. Dauzat’s recommendation. Councilman Bishop made a motion to accept the recommendation of the Code Enforcement Office and Councilman Dorn seconded it. The motion carried.

8. On motion by Councilman Dorn, seconded by Van Mol and passed, it was resolved to adopt an ordinance for annexation of property located at 150 Pine Grove belonging to Jamie and Michelle Stansell (J A Stansell Heating and Air). Roll call was as follows:

9. On motion by Councilman Martin, seconded by Councilman Bishop and passed, it was resolved to approve the reappointment of Elaine Ward to serve as commissioner for the Pineville Housing Authority.

10. On motion by Councilman Dorn, seconded by Councilwoman Van Mol and passed, it was resolved to accept for publication and refer to the Zoning Commission a petition for rezoning of property located on Pinehurst Drive belonging to Shannon Williams from R-1 to C-1A to allow for construction of a daycare facility.

11. On motion by Councilman Martin, seconded by Councilman Bishop and passed, it was resolved to approve a resolution:

WHEREAS, the City of Pineville has received the recommendation of Willis Engineering, Inc., Consulting Engineer, that the extensions of the municipal facilities of the City of Pineville, constructed by F & J Investments, L.L.C., as Developer and known as Hidden Path Subdivision, have been satisfactorily completed according to the plans and specifications previously approved by the City; and has received a form of Dedication of Facilities and Agreement for Maintenance from the Developer; and
WHEREAS, the City of Pineville has received a recommendation of acceptance from the City Engineer;
NOW THEREFORE BE IT RESOLVED, that the Mayor is hereby authorized to accept a dedication of said waterline facilities to the City of Pineville as a donation for public use as a part of the City’s municipal facilities provided the City is held harmless from all costs of liens, claims and damages, and provided the Developer furnishes all maintenance and repair on the facilities for two (2) years from the date of the acceptance of the dedication of the facilities to the City.

12. On motion by Councilman Martin, seconded by Councilman Bishop and passed, it was resolved to approve a resolution ordering and calling a special election to be held in the City of Pineville, State of Louisiana, to authorize the levy of a sales and use tax therein; making application to the State Bond Commission in connection therewith; and providing for other matters in connection therewith. Roll call was as follows:

Nays None

With no further business to come before the Council, a motion to adjourn was made by Councilwoman Van Mol, which was seconded by Councilman Bishop and unanimously passed. Mr. Lawrence Foster closed with the benediction.
